Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your access to and use of the MenuPOS platform, including the mobile application, web dashboard, APIs, and all related services (collectively, the "Service") provided by Qubelex Private Limited ("we," "us," or "our"), a company incorporated under the laws of India. By accessing or using MenuPOS, you agree to comply with this AUP in its entirety. This policy applies to all users, including business owners, staff members, administrators, and any individual who interacts with the Service.
This AUP supplements our Terms of Service and Privacy Policy. In the event of any conflict between this AUP and our Terms of Service, the Terms of Service shall prevail. We encourage you to read all of our policies carefully to understand your rights and obligations when using MenuPOS.
1. Purpose
The purpose of this Acceptable Use Policy is to define the boundaries of acceptable behaviour when using the MenuPOS platform. MenuPOS is designed to be a comprehensive point-of-sale and billing solution for food and beverage businesses operating in India. This policy exists to protect the integrity of the Service, safeguard the data of all users, and ensure a fair and secure environment for everyone who relies on MenuPOS for their daily business operations.
This AUP applies to all aspects of the Service, including but not limited to: the MenuPOS mobile application, any web-based tools or dashboards, APIs and integrations, data stored within the platform, communications facilitated through the platform, and any content uploaded or created by users. By using MenuPOS, you acknowledge that you have read, understood, and agree to abide by this policy. Violation of this AUP may result in suspension or termination of your account, as described in the Enforcement section below.
2. Permitted Use
MenuPOS is intended exclusively for legitimate food and beverage business operations. You are permitted to use the Service for the following purposes:
- Restaurant Billing and Invoicing: Creating, managing, and processing bills and invoices for dine-in, takeaway, and delivery orders. This includes generating GST-compliant invoices, applying taxes, charges, and discounts, and processing payments through supported payment modes.
- Order Management: Taking and managing customer orders across different order types, including dine-in, takeaway, delivery, and online orders. This includes tracking order status, modifying orders, and viewing order history.
- Menu and Catalog Management: Creating and maintaining your restaurant's menu, including adding items, setting prices, configuring tax profiles, organizing items into catalogs, and managing item modifiers and variations.
- Staff Management: Inviting staff members, assigning roles and permissions, managing access levels, and monitoring staff activity within the bounds of the platform's features.
- Reporting and Analytics: Accessing sales reports, revenue analytics, payment breakdowns, and other business intelligence features provided by the platform to make informed decisions about your operations.
- Customer Management: Storing and managing customer information for the purpose of order fulfilment, billing, and building customer relationships. This includes maintaining customer contact details, order history, and preferences.
- Table Management: Managing table layouts, sections, seating arrangements, and table sessions for dine-in operations.
You may only use MenuPOS for legitimate food and beverage business operations. If you wish to use MenuPOS for a non-food business, you must obtain prior written consent from Qubelex Private Limited by contacting us at support@menupos.in.
3. Prohibited Activities
You agree not to use the MenuPOS platform for any of the following activities. This list is not exhaustive, and we reserve the right to determine, at our sole discretion, whether any conduct violates the spirit of this policy:
3.1 Illegal and Fraudulent Use
- Using MenuPOS for any purpose that violates applicable local, state, national, or international law or regulation.
- Engaging in fraudulent activities, including but not limited to creating fake transactions, inflating sales figures, generating fictitious invoices, or misrepresenting business revenue.
- Using the platform to facilitate money laundering, tax evasion, or any other financial crime.
- Facilitating the sale of prohibited, counterfeit, or illegally obtained goods or services.
- Using MenuPOS to generate false financial records or manipulate accounting data for fraudulent purposes.
3.2 Content and Data Violations
- Uploading, storing, or distributing illegal, obscene, defamatory, or objectionable content through the platform.
- Storing sensitive personal data (such as Aadhaar numbers, full bank account details, or credit card numbers) in fields not designed for such information.
- Using the platform to distribute malware, viruses, trojans, ransomware, or any other malicious software.
- Uploading content that infringes on the intellectual property rights, trademarks, or copyrights of any third party.
3.3 Unauthorized Access and System Abuse
- Attempting to gain unauthorized access to other users' accounts, data, or business information.
- Using automated scripts, bots, scrapers, or crawlers to access, extract, or interact with the Service without explicit written permission from Qubelex Private Limited.
- Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the MenuPOS application.
- Interfering with or disrupting the Service, servers, or networks connected to the Service.
- Circumventing, disabling, or otherwise interfering with security-related features of the platform.
- Attempting to bypass or circumvent subscription plan limits, feature restrictions, or usage quotas through any technical means.
3.4 Account and Identity Violations
- Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
- Sharing your login credentials, invite codes, or authentication tokens with unauthorized individuals.
- Creating multiple accounts to circumvent plan limits, abuse free tier benefits, or evade enforcement actions.
- Using another person's account without their explicit authorization.
3.5 Harassment and Misuse
- Using the platform to harass, threaten, intimidate, or bully staff members, customers, or other users.
- Sending unsolicited bulk communications (spam) through any communication features of the platform.
- Using customer data collected through MenuPOS for purposes unrelated to your food business operations, including unauthorized marketing or selling customer information to third parties.
- Using MenuPOS for any business type other than food and beverage without obtaining prior written consent from us.
4. Data and Privacy
When using MenuPOS, you are responsible for handling data in a lawful and ethical manner. The following data-related obligations apply to all users:
- Compliance with Data Protection Laws: You must comply with the Digital Personal Data Protection (DPDP) Act, 2023, and all other applicable data protection regulations in India. This includes obtaining necessary consents from individuals before collecting, processing, or storing their personal data through MenuPOS.
- Customer Data Consent: Before storing any customer's personal information (including names, phone numbers, email addresses, and order history) in MenuPOS, you must have obtained appropriate consent from the customer. You are solely responsible for ensuring that your data collection practices comply with applicable privacy laws.
- Data Accuracy: You are responsible for maintaining the accuracy and completeness of all data you enter into MenuPOS, including menu items, pricing, tax profiles, customer information, and business details. Qubelex Private Limited is not liable for errors arising from inaccurate data entry.
- Prohibited Data Exports: You must not export, download, or transfer data from MenuPOS for any unauthorized purpose, including selling customer data, sharing it with competitors, or using it for purposes beyond the scope of your food business operations.
- Data Retention: You acknowledge that data stored in MenuPOS is subject to our data retention policies as outlined in our Privacy Policy. You are responsible for maintaining your own backups of critical business data where necessary.
5. Security
Maintaining the security and integrity of the MenuPOS platform is a shared responsibility. You agree to the following security obligations:
- Credential Security: You must keep your login credentials, including passwords and authentication tokens, confidential and secure. You are responsible for all activity that occurs under your account. We strongly recommend enabling two-factor authentication where available and using unique, strong passwords.
- Responsible Disclosure: If you discover a security vulnerability, bug, or potential exploit in the MenuPOS platform, you must report it to us promptly at support@menupos.in. Do not exploit, publicize, or share the vulnerability with third parties before we have had a reasonable opportunity to address it.
- No Security Breaches: You must not attempt to probe, scan, or test the vulnerability of the Service or any associated system or network. You must not attempt to breach, circumvent, or disable any security or authentication measures implemented in the platform.
- No Service Interference: You must not take any action that imposes an unreasonable or disproportionately large load on our infrastructure, or that interferes with the proper functioning of the Service. This includes denial-of-service attacks, automated mass requests, and intentional resource exhaustion.
- Device Security: You are responsible for ensuring that devices on which you access MenuPOS are adequately protected with up-to-date operating systems, security patches, and antivirus software. Compromised devices may pose a risk to your business data.
6. API and Integration Use
If you access or use any MenuPOS APIs, integrations, webhooks, or third-party connectors, the following rules apply:
- Authorized APIs Only: You may only interact with MenuPOS through officially documented and authorized APIs. Using undocumented endpoints, internal APIs, or exploiting unintended functionality is strictly prohibited.
- Rate Limits: All API access is subject to rate limits as specified in our API documentation. You must design your integrations to respect these limits and implement appropriate retry logic with exponential backoff. Exceeding rate limits may result in temporary or permanent suspension of API access.
- System Load: You must not design or operate integrations in a manner that places excessive load on MenuPOS systems. Bulk operations, mass data imports, and high-frequency polling should be performed responsibly and within documented guidelines.
- Data Attribution: When displaying or using data obtained from MenuPOS in external applications, dashboards, or reports, you must attribute the data to MenuPOS where required by our terms or API documentation.
- Integration Security: You are responsible for securing any API keys, tokens, or credentials used for integrations. Do not hardcode credentials in client-side code, share them in public repositories, or transmit them over insecure channels.
- Third-Party Compliance: If your integration involves third-party services, you are responsible for ensuring that your use of those services in conjunction with MenuPOS complies with both our policies and the third party's terms of service.
7. Enforcement
Qubelex Private Limited reserves the right to investigate and take appropriate action against any user who violates this Acceptable Use Policy. Our enforcement actions are severity-based and may include, but are not limited to, the following measures:
- Warnings: For minor or first-time violations, we may issue a written warning via email, notifying you of the violation and requesting immediate corrective action. Warnings will be documented on your account record.
- Feature Restriction: We may temporarily restrict access to specific features or capabilities of the Service if we determine that a user is misusing those features in violation of this policy.
- Temporary Suspension: For repeated violations, serious breaches, or ongoing non-compliance after a warning, we may temporarily suspend your account for a defined period. During suspension, you will not be able to access the Service or any data stored therein.
- Permanent Termination: For severe violations, including illegal activity, fraud, security breaches, or persistent non-compliance, we may permanently terminate your account and all associated data. Termination may be immediate and without prior notice in cases involving illegal activity or imminent harm.
- Legal Action: In cases involving illegal activity, significant financial harm, or repeated willful violations, we reserve the right to pursue appropriate legal remedies, including reporting violations to law enforcement authorities.
All enforcement decisions are made at the sole discretion of Qubelex Private Limited. We will endeavour to provide reasonable notice before taking enforcement action, except where immediate action is necessary to protect the Service, its users, or comply with legal obligations.
Appeals
If you believe that an enforcement action was taken against your account in error, or if you wish to appeal a decision, you may contact us at support@menupos.in with the subject line "AUP Appeal." Your appeal should include your account details, a description of the enforcement action, and your reasons for believing the action was unjustified. We will review all appeals in good faith and respond within 15 business days.
8. Reporting Violations
We encourage all users and third parties to report suspected violations of this Acceptable Use Policy. If you become aware of any activity that you believe violates this AUP, please report it to us promptly. Reports help us maintain a safe and fair environment for all MenuPOS users.
To report a violation, please send an email to support@menupos.in with the subject line "AUP Violation Report" and include the following information:
- Your name and contact information (optional for anonymous reports, but recommended for follow-up).
- A detailed description of the suspected violation, including what activity occurred and when.
- Any evidence supporting your report, such as screenshots, URLs, transaction IDs, or relevant communications.
- The account information of the suspected violator, if known (e.g., business name, email address, or MP Number).
All reports will be treated confidentially. We will investigate reported violations promptly and take appropriate action as described in the Enforcement section. We will not retaliate against any user who reports a violation in good faith.
9. Updates to This Policy
Qubelex Private Limited reserves the right to modify, update, or replace this Acceptable Use Policy at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you through the MenuPOS application, via email to your registered email address, or through a prominent notice on our website.
It is your responsibility to review this policy periodically for changes. Your continued use of the MenuPOS platform after any modifications to this AUP constitutes your acceptance of the updated policy. If you do not agree with any changes to this policy, you must discontinue your use of the Service immediately.
