The rules and guidelines governing your use of MenuPOS. Please read carefully before using the app.

1 Acceptance of Terms

By downloading, installing, accessing, or using the MenuPOS application ("App"), you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you are using MenuPOS on behalf of a business, you represent that you have authority to bind that business to these Terms.

If you do not agree to these Terms, you must not use MenuPOS. These Terms constitute a legally binding agreement between you and Qubelex Private Limited.

2 About MenuPOS

MenuPOS is a restaurant billing and point-of-sale software product developed and operated by Qubelex Private Limited, incorporated in India. MenuPOS is not a separately registered company — it is a software product offered under Qubelex Private Limited.

Qubelex Private Limited reserves the right to modify, suspend, or discontinue MenuPOS (or any feature thereof) at any time, with reasonable prior notice where practicable.

3 License to Use

Subject to your compliance with these Terms and payment of applicable subscription fees, Qubelex Private Limited grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the MenuPOS application for your internal business operations.

This licence does not include the right to:

  • Sublicense, resell, or redistribute the App or any part of it
  • Reverse engineer, decompile, or disassemble the App
  • Copy or replicate the App's features, UI, or underlying code
  • Use the App for any purpose beyond legitimate restaurant billing and management

4 Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and truthful registration information
  • Notify us immediately of any unauthorized access to your account
  • Not share your login credentials with unauthorized individuals
  • Use strong passwords and keep them secure

Qubelex Private Limited is not liable for any loss resulting from unauthorized use of your account where such use is due to your failure to protect your credentials.

5 Subscriptions & Billing

MenuPOS is available on a subscription basis with monthly and annual billing cycles. By subscribing, you authorize us (or our payment processor) to charge the applicable fees to your selected payment method.

  • Subscription fees are charged in advance (monthly or annually depending on your plan)
  • Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated
  • We reserve the right to change subscription prices with 30 days' prior notice
  • Downgrading or cancelling your plan takes effect at the end of the current billing period

6 Prohibited Uses

You agree not to use MenuPOS to:

  • Violate any applicable Indian or international laws or regulations
  • Transmit any viruses, malware, or malicious code
  • Engage in fraud, financial crimes, or generate fake invoices
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Scrape, harvest, or extract data from the App using automated means
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the App in a way that disrupts or damages our infrastructure

Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to appropriate authorities.

7 Intellectual Property

All intellectual property rights in MenuPOS — including but not limited to the software, user interface design, logos, trademarks, and documentation — are owned exclusively by Qubelex Private Limited. Nothing in these Terms transfers any ownership rights to you.

The "MenuPOS" name, logo, and brand identity are trademarks of Qubelex Private Limited. You may not use our trademarks without prior written permission.

8 Your Data

You retain full ownership of all business data you enter into MenuPOS (menus, orders, customer records, etc.). By using the Service, you grant us a limited licence to store, process, and display that data solely to provide the Service to you.

We will not access your business data except for technical support (with your permission), legal obligations, or security incident investigations. Please review our Privacy Policy for full details.

9 Disclaimers

MenuPOS is provided on an "as is" and "as available" basis. Qubelex Private Limited makes no warranties, express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Uninterrupted, error-free, or completely secure operation of the App
  • Accuracy or completeness of any data, calculations, or reports generated

You are solely responsible for verifying billing amounts, GST calculations, and financial records before use in your business operations. MenuPOS is a billing tool — it does not constitute professional accounting or tax advice.

10 Limitation of Liability

To the maximum extent permitted by applicable Indian law, Qubelex Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of MenuPOS.

Our total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the claim.

This limitation applies regardless of the form of action, whether in contract, tort, or otherwise, and even if we have been advised of the possibility of such damages.

11 Indemnification

You agree to indemnify, defend, and hold harmless Qubelex Private Limited, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from:

  • Your use of MenuPOS in violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any data you enter into the App that infringes on third-party rights

12 Termination

We may suspend or terminate your access to MenuPOS at any time, with or without notice, for violation of these Terms, non-payment of subscription fees, or for any other reason at our discretion.

You may terminate your account at any time by following the account deletion process within the App or contacting us. Termination does not entitle you to a refund except as specified in our Refund Policy.

13 Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

Before initiating legal proceedings, we encourage you to contact us to resolve the matter amicably. Most issues can be resolved quickly through our support channel at social@menupos.in.
